Adjudication

Adjudication is a legal process in which an adjudicator reviews the written evidence provided by the parties to come to a decision on what will happen to the deposit. We have undertaken training and a qualification in alternative dispute resolution (ADR) with the Chartered Institute of Arbitration and have adjudicated on many residential property cases.

Adjudicators are completely unbiased and make their decisions based on the evidence received from both parties. They must be persuaded “on a balance of probabilities” that the tenant has breached their tenancy agreement, and that the letting agent/landlord has suffered, or is likely to suffer, a loss as a result.
